Threatened QBCC licence suspension lifted
Circumstances / Situation
We were engaged by specialist building and construction lawyers to assist with a project where a very large business with a turnover in the $100s millions had received notices of threatened suspension of their licence from the QBCC. Any licence suspension would have meant the cessation of all building projects in Queensland with significant market issues, such as liquidated damages. It may have also attracted media interest.
Solution
We were able to review the paperwork and financials of the business in a short period of time providing practical advice and insight into how the QBCC financial requirements work. We then provided a range of options to the senior management team and their lawyers to ensure board approvals could be turned around quickly. This involved preparing new audited financials with a variety of legal documentation.
We also provided QBCC advice on several forward-looking issues identified as part of the process to ensure this does not happen again.
Outcome
The threatened QBCC licence suspension was lifted. New paperwork was lodged with the QBCC in a very short time frame in a structure that is more “future fit”.
